Biography: John F. McNally was born in the Peoria, Illinois in 1948, and raised in Pekin, Illinois. In 1974, Mr. McNally joined Fuller and Evans (the predecessor of Hamilton, Faatz and Waller, PC) as its pension and tax attorney. His principal responsibilities involved the newly enacted Employee Retirement Income Security Act of 1974 ("ERISA"), the drafting of all of the firm’s retirement plans to bring them into compliance with ERISA and the Internal Revenue Code, and business tax planning, formation and other transactional work. In 1977, John established his own legal practice in Boulder, Colorado. For over 35 years Mr. McNally has focused his practice in the following legal areas: governmental and private sector tax qualified pension, profit sharing and 401(k) plans; Section 457 plans; Section 403(b) plans; estate planning and probate; business acquisitions, sales and mergers; corporate, partnership, and limited liability company formations and operations; and executive and fringe benefit plans. Mr. McNally has advised the Colorado Legislature and the Governor with respect to Colorado police, fire and other public pension statutes, and assisted in the drafting of related legislation. He has also been a sponsor and speaker of the Colorado Public Pension Conference and the Chairperson of the Tax and Estate Section of the Boulder County Bar Association. Additionally, Mr. McNally is personally involved in closely-held businesses, which gives him hands-on and real-life experience in small business affairs and operations. Mr. McNally merged his non-pension practice into Hamilton Faatz and Waller, PC, in 2010. He continues to provide counseling and representation to his pension and profit sharing clients as John F. McNally, LLC.
