For Immediate Release– Mr. Faatz, on September 28, 2011, argued a water case before the Colorado Supreme Court on behalf of 14 individuals and groups residing in the San Luis Valley in the appeal stylized Lloyd Reynolds, et al. v. Craig Cotten, Division Engineer, Water Division 3, et al., Supreme Court of Colorado, Case. No. 2010SA393. The case involved the interpretation of water decrees dating from the 1960s and 1980s, involving La Jara Creek water rights, which have been the subject of several locally famous cases. Mr. Faatz’s clients were successful in the Division 3 water court proceeding and were defending Judge Kuenhold’s decision on appeal.

This year has been a particularly busy year in the legal arena. The 2010 election occurred on the eve of the expiration of many federal estate and income tax provisions contained in the Economic Growth and Tax Relief Reconciliation Act of 2001. Legislation enacted during the “lame duck session” extended and expanded many of these provisions – but only temporarily. The recent agreement to increase the federal debt ceiling in many ways only adds to the confusion. At the same time, the federal government has enacted major changes to the rules affecting health insurance, COBRA and Family Medical Leave, and the courts have delivered a number of contradictory opinions regarding these matters. We hope we will be able to clarify some of the confusion and provide a glimpse as to what the “Washington insiders” believe is going to happen. Finally, major changes in the law have impacted our clients who care for elderly and disabled family members and clients.

Ms. Ridgway’s and Ms. Ezer’s presentation entitled, Taking Care of our Parents: Alternatives for Family Members to Manage and Resolve Conflicts Involving Their Elderly Loved Ones, addressed strategies for framing, addressing and resolving potential and actual conflicts in the management of the care and finances of an elder.

Prior to joining the firm, Mr. Whitmer served as a personal trust officer for more than 30 years until he retired as a Vice President and Trust Officer at Colorado State Bank and Trust, N.A. in February of 2011. As Special Counsel Mr. Whitmer will provide advice and counsel to the firm’s clients in the areas of fiduciary law, trust administration, probate administration and estate planning.
